This is a waiver and release of liability between Zarlengo Holdings, LLC, DBA BodyWorX, a State of California Company (the “Company”), and USER/PURCHASER/VISITOR (the “Client”). BY USING THIS WEBSITE, THE PARTICIPANT AFFIRMS HAVING READ AND UNDERSTOOD AND IS IN AGREEMENT WITH THE WAIVER AND RELEASE OF LIABILITY CONTAINED BELOW, IN ADDITION TO THE TERMS & CONDITIONS AND TERMS OF SERVICE.
PROGRAM PARTICIPATION. The program(s) the Client has selected are by choice, and the Client agrees to pay any associated cost(s) as applicable and indicated.

I also understand and am aware that fitness activities involve a risk of injury, including a remote risk of death or serious disability, and that I am voluntarily participating in these activities and using equipment and machinery with full knowledge, understanding, and appreciation of the dangers involved. c) I, FOR MYSELF, AND ON BEHALF OF MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES, AND NEXT OF KIN, HEREBY RELEASE, HOLD HARMLESS AND PROMISE NOT TO SUE ZARLENGO HOLDINGS, LLC, DBA BODYWORX ASSOCIATES, THEIR OFFICERS, COACHES, VOLUNTEERS, STAFF, SPONSORS, AND/OR AGENTS, (“RELEASEES”) WITH RESPECT TO ANY AND ALL INJURY AND/OR LOSS ARISING FROM MY PARTICIPATION, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, EXCEPT THAT WHICH IS THE RESULT OF GROSS NEGLIGENCE OR WANTON MISCONDUCT.
d) I have read the Waiver and Release of Liability, fully understand its terms, understand that I have given up substantial rights by signing this agreement, and sign it freely and voluntarily without any inducement.
